Judge rules for Walgreen's on Big Pine Key

The Florida Keys Keynoter is reporting Monroe County Circuit Court Judge Richard Payne Monday ruled in favor of a settlement agreement between the county and Gadinsky Real Estate, LLC, the owners of the property.

Despite protests of some neighbors, odds point to a new Walgreen's drug store going up at the site of the old Scotty's hardware on Big Pine Key. A smaller store compromise is on the table.

The developers have been trying since 2004 to garner approval by the county's planning department to raze the existing structure and replace it with a drug store. The county planning commission denied Walgreen's request for the 26,000 square foot structure, and Walgreen's sued. In an effort to end the litigation, county staff negotiated a settlement agreement that addressed many of the concerns voiced by the community opponents. The company reduced the square footage to 16,500 square feet and earmarked excess footage for affordable housing. The agreement also limits truck deliveries.
